Motion for an Extension of Time – Template (April 2023)
Per Rule 26(a)(1), the last day of the period is included, unless it is a Saturday, Sunday, legal holiday, or day the Court is
closed at the direction of the Chief Judge.
Per Rule 26(b), any motion to extend the time set by these Rules or by an order or notice o f the Court beyond a total of 45 days
for a particular filing will be granted only for extraordinary circumstances.
Per Rule 26(b)(3), a motion to extend time does not extend the date on which a pleading or other document is due to be filed
with the Court unless the Court grants that motion. See Rule 5(b) (Effect of Stay).
Per Rule 26(d), a motion for leave to file an out-of-time motion to extend time may be filed with a motion to extend time.
