A request for conti nued examination (RCE) under 37 CFR 1.114 and the RCE fee under 37 CFR 1.17(e)

information c ontained in the IDS nec essitates the reopening of prosecution i n the application, the

undersigned unders tands that (i) the RCE will be processed and treated as an RCE under 37 CFR 1.114

and therefore (ii ) the IDS fee under 37 CFR 1.17(p) will be ret urned in ac cordance with

37 CFR 1.97(b)(4). In the event that no it em of information in the IDS nec essitates reopening prosecution,

the undersi gned understands that the RCE will not be proc essed and the RCE fee under 37 CFR 1.17(e)

will be returned.
