MOTION FOR PRODUCTION OF DOCUMENTARY EVIDENCE BEFORE TRIAL

Defendant moves the court for an order requiring production of documentary evidence before trial, and [he/she] states as follows:

1. Defendant is charged with the offense[s] of [offense charged], and [his/her] trial is set for [date of trial].

2. Defendant believes that documentary evidence exists [at [location of documentary evidence]] [in the possession of [person who possesses documentary evidence]]. Defendant will issue a subpoena duces tecum for these documents for trial, but Defendant needs the opportunity to analyze the evidence before the trial; otherwise the evidence will be meaningless and incapable of being intelligently used at trial.

3. This Court has the authority to issue a subpoena for production of documentary evidence before trial so it can be analyzed and evaluated for use at trial; Bowden v. Webb, 116 Ark. 310, 173 S.W. 181 (1915) (recognizing this power even if the opponent believes it to be a mere...
